Firm Prevails Before Louisiana Supreme Court

(Client: New Orleans City Council)

The firm obtained a major victory before the Louisiana Supreme Court on behalf of the New Orleans City Council in the closely watched litigation regarding the former Wisner Trust. In a prior ruling in the matter, the Fourth Circuit Court of Appeal had dismissed the City Council’s case, finding that the Council did not have independent capacity to bring suit. The firm brought the issue to the Louisiana Supreme Court, which, after granting the Council’s writ application, ordering full briefing, and hearing oral argument, reversed the Fourth Circuit and  agreed with the Council on all points. This major decision confirming that the New Orleans City Council has procedural capacity resolves a significant issue of public law for the City of New Orleans.

Judy Barrasso, Shaun P. McFall, Robert A. Waldrup, and Mithun B. Kamath handled the matter.
