Barrasso Usdin Prevails in Election Challenge Trial

Partners John Joyce and Michael Balascio secured a trial victory for their client in Orleans Parish Civil District Court. The firm was hired less than a week before trial to try the case on an expedited schedule. In successfully challenging the eligibility of the candidate for office, Joyce and Balascio demonstrated that the candidate’s financial disclosures were inadequate under applicable Treasury Regulations, the Internal Revenue Code, the Louisiana Revenue and Taxation Law, and the Louisiana Election Code. After the candidate was confronted on cross with previously undisclosed evidence of ongoing business activity, the court ruled that the candidate could not credibly demonstrate that his financial disclosures were accurate.
